What is domestic violence?

Domestic violence is classified as:

  • Physical or sexual abuse
  • Emotional or psychological abuse
  • Economic abuse
  • Threatening behaviour
  • Coercive behaviour
  • Control of or causing a person to hear for their safety or wellbeing.
  • Threatening to commit suicide or self-harm.

Application for a protection Order

To make a protection order, the court must be satisfied:

  • A relevant relationship existed between the aggrieved and respondent; and
  • Domestic violence was committed against the respondent; and
  • The Protection order is necessary to protect the aggrieved from further domestic violence.

Defending an Application for a protection Order

If you have been served with an Application for a protection order and disagree with its contents, it is important that you contact us immediately to obtain legal advice.

If you consent to an Order this can have an impact on licences you hold including weapon and security licences, you could be ousted from the family home and the order could apply for the mandatory period of 5 years.
